This limited warranty set forth below is given by Green Illuminating Systems, Inc. (“Seller”) with respect to the LED lamp product packaged with this limited warranty (the “Product”). Your Product, when delivered to you in new condition in its original packaging, will be free of defects in materials or workmanship for a period of as stated in WARRANTY EXHIBIT “A” from the date of original purchase. The determination of whether the Product is defective shall be made by the Seller in its sole discretion with consideration being given to the overall performance of the Product. A Product shall not be considered defective solely as a result of the failure of an individual LED component to emit light if the number of inoperable components is less than 30% of the total number of LED components in the product.

If Seller determines the Product is defective, Seller will elect, in its sole discretion, to refund the purchase price of the Product, repair the Product or replace the Product. If the Seller determines to refund the purchase price the refund will be prorated based on the years the product performed as prescribed. This limited warranty covers all defects encountered in normal use of the Product, and does not apply in the following cases: Loss of or damage to the Product due to abuse, mishandling, alteration, accident, electrical current fluctuations, power surges acts of God such as lighting strikes, failure to follow operating, maintenance or environmental instructions prescribed by Seller in writing or services performed by someone other than the Seller or its authorized service provider. REPLACEMENT, REPAIR OR REFUND IS GREEN ILLUMINATING SYSTEMS, INC. SOLE WARRANTY OBLIGATION. INCIDENTAL AND CONSEQUENTIAL DAMAGES ARE EXCLUDED. WARRANTY IS VOID IF PRODUCT IS NOT USED FOR THE PURPOSE FOR WHICH THIS PRODUCT WAS MANUFACTURED.

NO IMPLIED WARRANTY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTIBILITY OR FITNESS FOR A PARTICULAR PUPOSE APPLIES TO THE PRODUCT AFTER THE APPLICABLE PERIOD OF THE EXPRESSED LIMITED WARRANTY STATED ABOVE, AND NO OTHER EXPRESS WARRANTY OR GUARANTY GIVEN BY ANY PERSON OR ENTITY WITH RESPECT TO THE PRODUCT SHALL BIND SELLER.
